The use of www.horncastle.co.uk is subject to the following Terms and Conditions which you are asked to read through carefully.

www.horncastle.co.uk is owned by Horncastle Executive Travel Ltd, (referred to as 'We'). The access and use of our site by you, as a user, ('you'), constitutes your acceptance and agreement to these Terms and Conditions. They take effect from the date on which you first use this website.

You agree to use this site only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party. Any breach of this by you will result in legal action being taken by us against you.

Information collected by us is used to improve and customise the content of, and/or layout of, www.horncastle.co.uk.

You agree to indemnify Horncastle Executive Travel Ltd against any loss, liability, claim, demand, damage, or expenses, (including legal fees), that may occur in connection with the use of this site.

These Terms and Conditions shall be governed by the laws of England. Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England. You hereby consent to the exclusive jurisdiction of the courts of England in all disputes arising out of, or relating to, the use of this website. Use of this website is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation, this paragraph.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision. The remainder of the agreement shall continue in effect.

Virus Protection
We make every effort to check and test material at all stages of production. We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from this website.

We may, at any time, revise these Terms and Conditions without notice so you are asked to check these regularly. Continued use of www.horncastle.co.uk after a change has been made is deemed as your acceptance of the change.

ATOL 75244 Horncastle Executive Travel - Your Financial Protection
When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong. 

We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.

This section explains how Horncastle Executive Travel Ltd uses any information you give to us and the ways in which Horncastle Executive Travel Ltd protects your privacy.

Under the General Data Processing Regulations, Horncastle Executive Travel has a legal duty to protect any information we collect from you. Horncastle Executive Travel safeguards your data and maintains high security standards to prevent any unauthorised access to it.

In order for Horncastle Travel to fulfil its duties as a Travel Management Company, we need to collect, use and disclose personal information. These duties include the making and managing of travel bookings on behalf of our customers.

We are firmly committed to protecting the privacy and confidentiality of personal information provided by our clients and this commitment is taken extremely seriously by our organisation.

To ensure our commitment is sound, we maintain a number of physical, electronic and procedural safeguards to protect personal information in our care and to keep it secure.

By providing personal information to us, you agree on the points and the application of this Privacy Notice, in how we handle your personal information and that you also consent to us collecting, using and disclosing your personal information, as detailed in the Privacy Notice. If you do not agree to any part of this Privacy Notice, you must not provide your personal information to us, or if you withdraw consent previously granted, this may negatively affect our ability to provide travel services to you.

What Information Does Horncastle Collect From Its Customers?
The type of personal information we collect about you is the information required to facilitate your travel arrangements and for Horncastle to book, arrange and manage travel related services or products on your behalf.

Typically, this will include:
+ contact details, (name, address, telephone number, email address);
+ passport information;
+ payment account information, (credit/debit card details);
+ loyalty programme/frequent flyer details;
+ dietary requirements and health issues;
+ any other information relevant to your travel arrangements, as requested by the service provider;

How Is Personal Information Collected?
Any personal information collected is in full compliance with GDPR regulations.

The required information will be collected from you in your dealings with Horncastle, either in person, by telephone or email. Similarly, when you visit our website or connect with us via social media.

In some circumstances, we may collect information about you from a third party, for example, when someone makes a booking on your behalf, such as a family or group booking or a booking made on your behalf by your employer. In these instances, we will rely on the authority of the person making the booking to act on behalf of the traveller.

When a travel booking is made on behalf of another person, you agree that consent is obtained from the other person, in order for Horncastle to collect, use and disclose his/her personal information, in accordance with this Privacy Notice and that the other person is fully aware of this Privacy Notice.

You must inform Horncastle immediately if you become aware that your personal information has been disclosed to us by another person without your prior consent. Also, Horncastle must be informed if you did not obtain consent from another person before passing that information to us.

Whilst every effort is made by our staff to maintain and update personal information that is stored, we do respectfully request that Horncastle is made aware of any changes to the personal information we hold or if there is inaccurate information held on you. Horncastle will not be responsible for any incurred losses arising from inaccurate or incomplete personal information that you, or a person acting on your behalf, provide to us.

How Is Your Personal Information Used?
We will only process your personal information where:

+ you have given your consent to such processing;
+ the processing is necessary to provide our services to you;
+ the processing is compliant with our legal obligations;
+ the process is necessary for our legitimate interests;

When you book or arrange travel related products and services through Horncastle, we usually act as agent for the relevant travel service providers. We will collect personal information about you, both for our internal purposes, as described in this Privacy Notice, as well as for the travel service provider, for whom we act as agent. We may, therefore, share your information with or travel service providers, such as airlines, hotels, car rental companies or other providers, who fulfil your travel requests. These travel service providers may also use your personal information as described in their respective privacy policy and may contact you, as necessary, to obtain additional information about you, facilitate your travel; arrangements or provide you with your requested services. Horncastle encourages its customers to review the privacy policies of any third party travel service providers whose products you purchase through us. These third party policies can be provided on request.

We may send your details outside the European Economic Area, (EEA), eg if your holiday is outside of the EEA and the hotel needs to be advised of your details. Please be aware that in such cases, controls on data protection outside the EEA may not be as strict as in the UK, due to the global nature of the internet infrastructure.

How Long Do We Hold Your Data For?
We will keep your personal information only for as long as is required to continue to fulfil the services required by our Clients. If you do not wish us to continue holding your data, please advise us by email or in writing, requesting your personal information to be deleted.

The personal information provided by you to us will only be used in the administration of the products and services you have requested from us. Your details will not be added to any marketing lists unless you have given us clear consent to do so. Your information will be held for our internal use to allow us to improve the services and products we offer, your customer experience and to enable us to comply fully with our contractual obligations. If you telephone us, calls may be recorded for training and quality purposes.

If, as a previous customer of Horncastle Travel, you have received marketing material from us before 24th May 2018, you will continue to receive information from us under the basis of legitimate interest.

If you have given us permission to use your data for marketing communications or have been receiving marketing material from us since 24th May 2018, you can unsubscribe at any time, if you change your mind, by either clicking on the unsubscribe link within the marketing emails you receive, by using the contact information provided on postal marketing or by contacting Horncastle directly.

Your Rights In Relation To The Personal Information We Collect

If you wish, you may:
+ update, modify, delete or obtain a copy of the personal information that we hold on you;
+ restrict or stop us from using any of the personal information which we hold on you, including the withdrawal of any consent previously given to the processing of such information;
+ request a copy of your personal information in a suitable format, where any personal information has been processed on the basis of your consent or as necessary, in order to perform a contract to which you are a party.

You may request this by contacting Horncastle by email or in writing where you will receive an acknowledgement of your request.

We endeavour to respond to such requests within one month or less although Horncastle reserves the right to extend this period for complex requests. In certain situations, we reserve the right to deny you access for any reason permitted under applicable regulations. Such exemptions may include national security, corporate finance and confidential references. If we deny access or data correction, we will provide you with written reasons for such denial unless it is unreasonable to do so. Where required by data protection regulations, we will note your request and denial of same in our records.

Please note that should you request that we restrict or stop using personal information we hold on you or withdraw a consent previously given to the processing of such information, this may affect our ability to provide full services to you or negatively impact the services we can provide to you. For example, the traveller’s full name, as appears on their passport, will be required, as well as contact details and valid identification

We cannot make bookings for you without this information.

You must always provide accurate information to Horncastle which must be updated by you whenever necessary. You also agree that, in the absence of any update, we can assume that the information submitted to us is correct.

In any of the situations listed above, we may request proof of identity by providing us with a copy of a valid means of identification for us to comply with our security obligations and to prevent unauthorised disclosure of personal information.

We reserve the right to charge you a reasonable administrative fee for any manifestly unfounded or excessive requests concerning your access to your personal information and for any additional copies of the personal information you request from us.

How We Protect Your Information
By submitting your personal data, you agree to the storing and processing of this data. We will take all reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy.

We do not and will not sell, rent out or trade your personal information. We will only disclose your personal information to third parties in the ways set out in this Privacy Policy and in accordance with UK data protection laws. (Please note that the term “disclose” includes to transfer, share, either verbally or in writing, send or otherwise, make available or accessible your personal information to another person or entity).
